Robeson County – Court of Appeals Orders Conditional Use Permit of 54-Acres

Background:  Solar farm company FLS Energy Inc.  petitioned the Robeson County Board of Commissioners for a conditional use permit to construct a solar farm.  The property is 54-acres and is owned by Charles Andrews. In 2015, the Commissioners denied the conditional use permit.  Since that time, FLS Energy sued.

In 2016, Robeson County Superior Court agreed with the County Commissioners.  The case proceeded to the State Court of Appeals where Judges John Tyson, Marie Calabrie and Linda McGee overturned the decision this week.  FLS Energy has now been granted the permit.

Location:  The land is located on N.C. 710, St. Anna Church Road (northwest of Pembroke)
